Independent Status Notice
Modena Woods is an independent commercial entity. Modena Woods is not an agency, bureau, subsidiary, or affiliate of the City of Philadelphia, the Commonwealth of Pennsylvania, or the federal government.
02
Zero Engineering, Architectural, or Legal Advice
Modena Woods is strictly an information aggregation provider. Modena Woods is not a professional engineering firm, architectural practice, licensed legal practice, certified expediter, or construction management consultant.
None of the intelligence briefs, lead summaries, violation analyses, zoning previews, or contractor tracking logs generated by Modena Woods constitute:
Structural, civil, mechanical, electrical, plumbing, or fire protection engineering assessments.
Architectural feasibility studies, building code interpretations, or CAD calculations.
Formal legal advice, litigation guidance, or statutory regulatory counsel.
Guarantees of project viability, contractor solvent status, or bidding success.
Mandatory Independent Verification: Subscribing union officials, organizers, chief estimators, and contractor executives must perform their own independent physical site inspections, contract reviews, structural engineering calculations, and legal examinations prior to committing capital, submitting formal commercial bids, or taking field enforcement actions.
03
"As-Is" Data Provision & Municipal Variance Disclaimer
All briefings, email dispatches, and reports are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranty of any kind, whether express, statutory, or implied.
Municipal public databases undergo continuous administrative updates, clerical modifications, case dismissals, compliance clearances, and retroactive filings. While Modena Woods deploys automated cross-referencing and entity verification checks to maximize data fidelity:
Modena Woods does not warrant or guarantee that municipal feeds are 100% complete, error-free, uninterrupted, or real-time.
A municipal citation listed as active may be resolved or appealed with the City subsequent to publication.
Corporate management phone numbers and executive titles are compiled from public state corporate registries and verified business records, but are subject to unannounced entity changes.
MODENA WOODS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
04
Strict Limitation of Liability & Dollar Cap
To the maximum extent permitted by applicable Pennsylvania and federal law, in no event shall Modena Woods, its founder, officers, affiliates, or contractors be liable to any subscriber, preview recipient, contractor, labor organization, or third party for:
• Any indirect, incidental, special, exemplary, or punitive damages.
• Lost bids, lost profits, missed deadlines, or lost commercial opportunities.
• Estimating miscalculations, travel expenses, or jobsite mobilization costs.
• Labor disputes, regulatory citations, or third-party claims.
Total Liability Dollar Cap
Under all circumstances, the maximum aggregate liability of Modena Woods for any and all claims, disputes, or causes of action arising out of or related to our services, dispatches, or website shall be strictly capped at and limited to the total amount actually paid by the client to Modena Woods in the three (3) months preceding the incident, or $100.00 USD in the case of complimentary trials or promotional previews.
While raw municipal filings are public record, the specialized synthesis, proprietary scoring, trade-siloing taxonomy, contractor tracking databases, entity disambiguation algorithms, and visual briefing architectures created by Modena Woods constitute valuable trade secrets and proprietary copyrighted compilations.
